Withdrawal

Consumers generally have the right to withdraw from a distance contract within fourteen days without giving any reason, unless a statutory exception applies.

The declaration of withdrawal does not require a particular form. It is sufficient for the withdrawal declaration to be sent within the applicable withdrawal period.

Special rules apply where the contract concerns digital content that is not supplied on a physical data carrier, such as a downloadable photograph.

Where the customer is required to make a payment, the right of withdrawal may expire when performance begins if all applicable statutory requirements are fulfilled.

This includes the customer expressly agreeing that performance may begin before expiry of the withdrawal period and confirming awareness that the right of withdrawal is thereby lost.

The applicable contractual confirmation must also contain the legally required information.

Where epm.visuals offers immediate access to paid digital content, the checkout may therefore require separate express confirmations before immediate delivery begins.

If the statutory requirements for loss of the right of withdrawal are not fulfilled, the customer's statutory rights remain unaffected.
