02

Scope

These terms apply to the acquisition and use of digital image files made available through epm.visuals unless a separate individual licensing agreement has been concluded.

Mandatory statutory rights of consumers remain unaffected.

03

Digital content

Downloads offered through epm.visuals consist of digital photographic content that is not supplied on a physical data carrier.

The specific image, price and essential characteristics of the digital content are displayed before the order is submitted.

Unless otherwise expressly stated, the digital file is made available for download electronically after successful completion of the applicable ordering process.

04

Prices and payment

The price displayed immediately before the order is submitted is the applicable price for the selected digital content.

Payments are processed through Stripe. epm.visuals does not store complete payment card information.

Any tax treatment required under applicable law remains subject to the legal status and tax obligations of the provider.

05

Formation of contract

The presentation of digital content on the website does not by itself constitute a binding contractual offer.

A binding order is placed when the customer completes the checkout process and submits the payment through the payment interface.

The contract is concluded when the order is accepted and the digital content is made available in accordance with the checkout process.

06

Licence granted

Unless a different licence is expressly stated for a specific image, the customer receives a non-exclusive, non-transferable licence for personal, non-commercial use.

The licence permits the customer to store the downloaded file and use it privately, for example as a personal device background or within a private collection.

07

Uses not included

The standard personal-use licence does not include the right to:

  • use the image for commercial advertising, marketing or promotional purposes;
  • resell, sublicense, redistribute or make the original file available to third parties;
  • offer the image through stock photography platforms or other image libraries;
  • use the image as part of merchandise, products or services offered for sale;
  • claim authorship or ownership of the underlying photograph.

Commercial or extended licences may be requested separately through the contact options provided on the website.

08

Copyright

Copyright and all intellectual property rights in the photographic work remain with the respective rights holder.

Purchase of a digital file does not transfer copyright or ownership of the underlying photographic work.

Only the usage rights expressly granted by the applicable licence are transferred.

09

Right of withdrawal

Consumers may generally have a statutory right to withdraw from a distance contract.

Special rules apply to digital content that is not supplied on a physical data carrier. Where the statutory requirements are met and the customer expressly requests immediate performance and acknowledges the resulting loss of the right of withdrawal, the right of withdrawal may expire when performance begins.

Further information is provided on the withdrawal information page.

10

Statutory warranty

Statutory warranty rights are not excluded or restricted by these terms.

Where the customer is a consumer and the subject matter is digital content, the applicable statutory provisions governing digital services and digital content apply.

If a downloaded file is defective or cannot be provided as agreed, the customer may be entitled to the remedies provided by mandatory law.

11

Technical availability

epm.visuals aims to provide digital files promptly after successful completion of the required process.

Temporary technical interruptions may occur. If a valid download cannot be accessed, customers may contact epm.visuals using the contact details provided on the website.

12

Unauthorised use

Nothing in these terms permits the removal of copyright notices, technological access restrictions or other rights-management information where such measures are used.

Use outside the scope of the granted licence requires separate permission from the respective rights holder.

13

Applicable mandatory law

These terms do not restrict statutory rights that cannot legally be excluded or limited, in particular mandatory consumer protection rights.

Any choice of law or contractual provision is subject to mandatory rules applicable to the customer under Austrian and European consumer protection law.
